Copyright and Entertainment Law
Anyone may only broadcast if he or she is licensed to do so, Art. 52 Para.. 1 p. 1 Media State Treaty (MStV). One of the 14 media authorities in Germany is responsible for such licensing. Whether a project requires a license, which state media authority is responsible, or whether a broadcasting license obtained abroad entitles the broadcaster to broadcast the program in Germany are questions on which we advise, recommend the necessary measures, prepare the application for the broadcasting license, and accompany the administrative procedure up to the licensing. In parallel, it is necessary to consider how to secure the dissemination channel for which an allocation is still needed.
We also advise on media content, whether it is a software license, film license, merchandising agreement, publishing agreement, film production agreement, work made for hire or GNU GPL.
